Terms and Conditions Road Trip Car

These Terms of Use apply to the use of websites and services offered by Road Trip Car V.O.F. (hereafter: Road Trip Car), registered with the Chamber of Commerce under number 76655660, VAT number NL860727750B01, located at Statenbolwerk 6C, 7202DB Zutphen, the Netherlands.

Article 1 – Introduction

These Terms apply to the use of websites managed by Road Trip Car, where users can find information about travel and car rentals. Users can use Road Trip Car's websites to compare, reserve, or purchase travel-related products and services, particularly in the field of car rental. By visiting Road Trip Car's websites, you agree to these Terms.

Article 2 – Definitions

In these Terms, the following terms are used with the meanings provided below, unless explicitly stated otherwise. Terms used in the singular shall include the plural and vice versa unless otherwise indicated by context.

Platform: The websites and interfaces owned and/or managed by Road Trip Car, where rental cars are compared and booked, and travel-related information and services are offered.
Services: Road Trip Car aims to connect Users and Providers of products and/or services through its Platform. Road Trip Car has a facilitating role, matching supply and demand. Additionally, Users can find travel and car rental information on the Platform.
Offer: The offer made by a Provider to a User.
User: The natural or legal person, whether acting professionally or privately, who uses the Platform.
Provider: The natural or legal person, acting professionally, who offers vehicles for rent and/or other services or products related to car rentals and travel via the Platform or through referrals from the Platform.
Partner: The natural or legal person, acting professionally, with whom Road Trip Car collaborates to connect Users with Providers or who provides supporting technologies used by Road Trip Car in delivering its Services, such as payment providers.
Rental Company: The car rental companies that make their offers available via the Platform, directly or via Partners.
API Provider: The external party facilitating booking and payment processing.
Terms: This document, detailing the terms of use applicable to the use of the Platform and the Services.

Article 3 – Applicability

These Terms apply to the use of the Platform by every User and Provider.
Deviations from these Terms are not permitted.
Any general terms and conditions from Users acting professionally are explicitly excluded.
Road Trip Car handles Users' personal data with care. Personal data processing occurs solely to provide Road Trip Car’s Services. Road Trip Car will not process personal data for any other purposes and will never retain such data longer than necessary. More details can be found in Road Trip Car's Privacy Statement.
Road Trip Car's Platform is generally not accessible to minors unless the minor (16 years or older) can demonstrate written consent from a parent and/or legal guardian confirming permission to independently carry out the relevant action, except where such action is commonly accepted in society without written consent.
As the Platform’s administrator, Road Trip Car is never a contracting party to agreements concluded between Users and Providers or Rental Companies.
Road Trip Car acts solely as an intermediary and is not responsible for the actual rental of vehicles. Rental agreements are concluded directly between the User and the Rental Company.
Road Trip Car has no control over the Offer or the Provider offering it. Therefore, Road Trip Car does not guarantee the quality, suitability, completeness, accuracy, (il)legality, reviews, and/or ratings related to the Offer and Provider. Road Trip Car emphasizes that each User has an independent responsibility to investigate whether the presented Offer meets the User's requirements in these aspects. Any images included in an Offer are illustrative only. Users cannot derive any rights from these images, which are never to be considered as approved by Road Trip Car.
Road Trip Car may offer and deliver the Platform’s Services, in whole or in part, through other channels, such as email, social media, and other online and offline advertisements. Users may be required to use third-party websites to take advantage of Offers or purchase services or products. In such cases, the specific third-party's terms and conditions will apply.
The Platform and/or Offers may contain links to third-party websites. Different cookies and/or privacy policies may apply on these third-party websites. Road Trip Car is not responsible or liable for the availability or accuracy of the content on these third-party websites. Links to third-party sites do not imply Road Trip Car's endorsement of the third party or its services.
In addition to these Terms, Users may also be subject to terms and conditions imposed by the actual Provider or Rental Company, which the User must accept and understand.

Article 4 – Agreement with the Provider

Road Trip Car solely provides a Platform that Users can utilize and has no influence over arrangements or the fulfillment of any agreements concluded between Users and Providers via the Platform.
The Offer is generally managed, controlled, or provided by the Provider, either directly or as a booking agent. If Users purchase services from a Provider or enter into an agreement with a Provider, Users must read and agree to the Provider's terms, conditions, and privacy statement prior to concluding the agreement. Additionally, Users may also be subject to conditions from the actual travel supplier, which Users must accept and understand.
If Users purchase services from a Provider or enter into an agreement with a Provider, Users must read and agree to the Provider's terms and conditions prior to concluding the agreement.
The Provider is always responsible for executing the agreement between the User and Provider. Users are solely responsible for providing accurate and complete information to the Provider. Any consequences arising from inaccuracies or incompleteness will be at the User's risk and expense.
Road Trip Car is never responsible or has influence over the execution of services and/or products offered by the Provider. In particular, Road Trip Car is neither responsible nor liable for the technical safety or suitability of the rented vehicle, nor the associated insurance. In this respect, any claims by Users are exclusively directed to the Provider and/or the locally involved travel supplier.

Article 5 – Execution of Services

Road Trip Car strives to provide its services with the utmost care, as expected from a good service provider. Road Trip Car guarantees professional and independent service provision. All Services are provided exclusively on a best-effort basis.
The information and data provided by Users and Providers form the basis upon which Road Trip Car delivers its Services.
If information provided by the User and/or Provider needs adjustment, this may affect the planning and costs involved. Road Trip Car is never liable for adjusting such planning.
Road Trip Car has the right to engage third parties at its own discretion to perform its Services.
Road Trip Car solely offers a Platform through which various Providers can showcase their Offers to Users. Road Trip Car cannot guarantee the Offers or the products/services provided by Providers.
The Platform may contain links to other websites that Road Trip Car neither manages nor controls, and for which Road Trip Car bears no responsibility. These links are provided for reference and user convenience. Road Trip Car does not endorse the content of other websites and accepts no liability for any loss or (financial) damage arising from their use. Users must review and comply with the individual terms of use, privacy policies, and other guidelines available on such third-party websites.

Article 6 – Obligations

Users must provide all information and related data requested by Road Trip Car, before the commencement of services, in the desired format to ensure accurate and effective service delivery. If Road Trip Car does not receive accurate information, it may be unable to deliver optimal services. The consequences of such a situation are entirely the User's responsibility and risk.
Road Trip Car is not obligated to verify the accuracy or completeness of information provided, nor to update Users about information changes over time. Furthermore, Road Trip Car is not responsible for the accuracy or completeness of information compiled by Road Trip Car for third parties or provided to third parties in connection with the Services. Information presented on the Platform is primarily based on online bookings and reservations relating to travel and car rentals and may differ from the final Offer.
Users have an independent duty and responsibility to conduct research on the selected or proposed Provider and the services offered by such Provider. Road Trip Car shall fulfill its own due diligence and informational obligations, where applicable.
Users must always promptly and fully comply with obligations arising from agreements made with the relevant Provider.
Users may only use the Platform and register as members if they are of legal age and capable of entering into binding agreements.
Users are responsible for maintaining the confidentiality of passwords, login, and account details when registering as members or making bookings via the Platform.
Users may only use the Platform to seek legitimate offers and must not use the Platform to make false, fraudulent, speculative bookings, or bookings made in anticipation of future demand.
By using the Platform, Users agree that they will not, without explicit and written permission from Road Trip Car:
1. Resell, spider, scrape, reproduce, use, copy, display, or download any data, content, software, reservations, tickets, products, or services listed or offered on the Platform for any commercial, non-commercial, or competitive purpose or activity.
2. Violate any restrictions or circumvent any measures intended to limit or prevent access to the Platform.
3. Use any device, software, or routine that interferes or attempts to interfere with the normal operation of the Platform or perform any actions that create an unreasonable load on computer or network equipment used by Road Trip Car to provide its Services.
4. Duplicate, copy, sell, trade, resell, or exploit the Platform.
5. Modify, decompile, reverse engineer, or attempt to obtain the source code of the Platform in any manner.
6. Use the Platform to collect personal data about others.
7. Use the Platform for any commercial purpose.

Article 7 – Display of Results

Road Trip Car aims to present relevant search results by providing a—potentially personalized—standard sorting of Providers on the Platform. Users can filter, sort, compare, and further explore these results. Road Trip Car uses algorithms to generate this sorting, continuously improving these algorithms.
The display of search results for travel products, rental cars, or Offers on the Platform does not imply any recommendation or endorsement by Road Trip Car regarding these results, nor does it suggest any affiliation between Road Trip Car and the Provider.
Road Trip Car displays content provided by or originating from Providers and actual travel suppliers, possibly collected by Road Trip Car. Road Trip Car is not responsible in any way for the accuracy, availability, timeliness, or completeness of this content. Users are responsible for thoroughly reviewing the terms associated with the final acceptance of any Offer.
Road Trip Car provides an estimation of additional costs that may be charged to Users upon accepting an Offer. These costs are estimates only and may differ due to Provider price changes and currency conversions. Users cannot derive any rights from prices displayed on the Platform.
Road Trip Car presents a concise summary of insurance coverage, applicable deductibles, and estimated rates and coverage options for optional insurance packages. Coverages, amounts, and rates are for informational purposes only and may vary due to price changes, currency conversions, or exceptions not displayed in the summary on the Platform. Users cannot derive any rights from the insurance-related information provided on the Platform.

Article 8 – Advice

If requested, Road Trip Car can provide advice, a strategy, planning, and/or reporting to facilitate its Services. Such content is advisory, non-binding, and provided with due care to Road Trip Car’s obligations regarding diligence and information. Users independently decide whether to follow any advice given.
Advice provided by Road Trip Car, in any form, can never be considered binding.
The nature of the services means that outcomes are always dependent on external factors affecting the advice given by Road Trip Car, such as the quality, accuracy, and timely provision of necessary information by Users and Providers (and/or their representatives). Users guarantee the quality and timely delivery of the required information and data.
Users must inform Road Trip Car via the Platform, prior to the start of services, of all circumstances that are or could be relevant, including points and priorities requiring attention. If this is not possible, Users must notify the Provider about these points before agreeing to the Offer.

Article 9 – Free Services

Road Trip Car provides its services to Users free of charge. Road Trip Car will not charge Users for Services provided. Road Trip Car receives compensation from Providers and/or Partners within its network for the provided services.
Road Trip Car may offer compensation or rewards to Users for products or services acquired via the Platform. This is possible only if Road Trip Car has received compensation from the specific Provider or Partner through which the product or service was acquired, during active promotional campaigns from Road Trip Car for such specific products or services, and when Users make bookings from their user accounts on the Road Trip Car website.
Road Trip Car may offer additional premium services and features to Users, for which fees may apply. Road Trip Car will clearly inform Users about which parts of the Platform are free and which are premium and subject to charges.

Article 10 – Website Availability

Road Trip Car does not guarantee that its Services will always meet previously set expectations. Road Trip Car strives to provide uninterrupted access to the Platform but cannot guarantee constant availability. Road Trip Car may suspend use of the Platform if it determines there is a risk to its proper functioning. In such cases, Road Trip Car is entitled to take all reasonable measures necessary to ensure effective operation of the Platform.
Road Trip Car is not responsible for interruptions or disruptions to the internet or telecommunications infrastructure beyond its control, potentially causing downtime or unavailability of the Platform. Road Trip Car may temporarily limit the Platform’s availability, considering Users' legitimate interests, if it is deemed necessary due to capacity constraints, server security/integrity, or Platform maintenance. Road Trip Car has the right to perform maintenance and introduce new features to the Platform.
Road Trip Car is never responsible or influential regarding the execution of Offers by Providers, and does not guarantee the quality of Offers, the Provider’s authorization to provide services, or the accuracy and completeness of information provided. Each User is independently obligated to investigate services offered by Providers. All displayed information and figures on the Platform are subject to spelling or typographical errors. Road Trip Car is never liable if the service does not meet User expectations.
Prices for Offers fluctuate continuously, meaning Road Trip Car cannot guarantee that prices mentioned on the Platform match actual Offer prices. Users are responsible for verifying current Offer prices before making payment, purchase, or reservation.

Article 11 – Prices and Payments

All prices on the Platform include taxes and surcharges unless otherwise stated.
Payments are processed via our Partner or API Provider and may vary depending on the selected payment method.
We reserve the right to modify prices before a booking is finalized.
Road Trip Car displays estimated costs and prices that may be charged to Users upon accepting an Offer. Actual costs and prices may vary due to Provider or Rental Company price changes, currency conversions, and technical errors. Users cannot derive rights from prices displayed on the Platform.

Article 12 – Payment Terms

Payment must be made at the time of booking unless otherwise indicated.
Any additional costs, such as deposits, extra drivers, or insurance, must be paid either online or directly to the Rental Company upon vehicle pick-up, depending on the specific Offer.

Article 13 – Security Deposit

Most Rental Companies require a security deposit upon vehicle pick-up.
The amount and accepted payment methods for the deposit vary by Rental Company and vehicle category.
The return of the security deposit is subject to the terms and conditions of the Rental Company.
Payment and refund of the deposit do not occur through Road Trip Car.

Article 14 – Vehicle Pick-up and Return

Users must adhere to the pick-up and return times specified by the Rental Company.
Additional fees may apply if vehicles are picked up or returned too early or late.
If a vehicle is picked up late without prior notification, the Rental Company may cancel the booking without providing a (full) refund, according to the Rental Company's cancellation policy.
Pick-up or return outside regular business hours may incur additional charges.
In case of delays, Users are solely responsible for informing the Rental Company and coordinating adjustments to schedules. The Rental Company will determine whether changes to the schedule will result in consequences or if a lenient approach is applicable.

Article 15 – Delivery and Collection Service

Some Rental Companies offer vehicle delivery or collection services at an additional cost.
Availability and fees for these services vary by location and Rental Company.

Article 16 – Vehicle Category and Availability

Bookings are made based on vehicle categories, not specific vehicle models.
If the booked category is unavailable, the Rental Company may offer an alternative.

Article 17 – Insurance and Excess Coverage

Rental cars typically include basic insurance coverage, often with an excess (deductible).
Additional insurance options may be available through the Platform, Rental Company, or third parties, depending on the specific Offer.
Coverage details and exclusions vary between insurers and Rental Companies.
Road Trip Car provides a concise summary of insurance coverage and optional insurance modules. Coverage details and related context evaluations serve only as guidance for Users and may differ due to pricing changes, currency conversions, or exceptions not detailed in the concise summary on the Platform. Users cannot derive rights from the insurance information provided on the Platform.

Article 18 – Additional Coverage and Optional Equipment

Extra insurance coverage, such as full damage protection, can be purchased separately. Depending on the specific Offer, this can be arranged either via the Platform or directly with the Rental Company.
Optional equipment, such as child seats and GPS navigation systems, may be available for an additional fee.

Article 19 – Driver's License and Additional Drivers

Drivers must present a valid driver's license that has been held for at least the minimum required period. The Rental Company's terms specify how long this period is.
Additional drivers must be registered in advance and may be subject to extra fees.

Article 20 – One-way Rentals and Cross-border Travel

Returning the vehicle to a different location (one-way rental) may incur additional charges.
Traveling to other countries with the rental vehicle may not always be permitted and must either be confirmed in advance by the Rental Company or explicitly stated in the applicable terms.

Article 21 – Cancellation and Modification of Bookings

Cancellations and modifications are subject to the terms and conditions of the Rental Company.
If applicable, cancellation fees may be charged.
Refunds are only granted if permitted by the Rental Company.

Article 22 – Refunds

If a refund is granted, it will typically be processed via the original payment method. Exceptions to this may occur due to specific reasons.
Processing times for refunds vary depending on the payment provider.

Article 23 – Limitation of Liability

Road Trip Car is not liable for any failure to fulfill its obligations due to force majeure, nor can it be held to perform any obligation if prevented by circumstances beyond its reasonable control, and not attributable to fault, or as defined by law, legal actions, or commonly accepted practices. Force majeure includes, without limitation, circumstances as defined by law and jurisprudence, such as: (i) force majeure events affecting Road Trip Car’s suppliers, Partners, and Providers; (ii) failure of suppliers, Partners, and Providers to meet obligations; (iii) defects in third-party goods, equipment, software, or materials; (iv) governmental actions; (v) power outages; (vi) disruptions in internet, data networks, or telecommunication facilities (e.g., cybercrime and hacking); (vii) fire; (viii) natural disasters; (ix) war or terrorism; (x) widespread transportation issues; (xi) strikes within Road Trip Car’s business operations; and (xii) other situations deemed beyond Road Trip Car’s control, temporarily or permanently hindering compliance.
To the extent permitted by law, Road Trip Car excludes all liability for damages suffered by the User arising from: (i) using Road Trip Car’s Services; (ii) performance of Provider services via the Platform; (iii) the Platform being unavailable or not fully or securely accessible; (iv) changes to the Platform or Road Trip Car’s Services; (v) inaccurate or incomplete information on the Platform; and (vi) any loss, damage, or viruses affecting the User’s computer equipment or property as a result of using the Platform or downloading content from the Platform.
The content on the Platform is primarily generated automatically; errors can and will occur. Road Trip Car explicitly disclaims all warranties and conditions, express or implied, including but not limited to implied warranties of title, non-infringement, security, accuracy, and warranties arising from trade practice, transaction conduct, or usage.
Road Trip Car excludes all consequential damages.
If and insofar as Road Trip Car is found liable, liability is limited to a maximum amount of €100.
All claims by the User due to shortcomings on Road Trip Car’s part must be reported to Road Trip Car in writing and supported by evidence within one year after the User became aware or reasonably could have become aware of the facts on which the claims are based. Road Trip Car’s liability expires one year after the termination of the agreement between the parties.
Road Trip Car is not responsible for errors or inaccuracies in information provided by Rental Companies.
Road Trip Car is not liable for any damage, loss, or costs arising from the use of rental vehicles.

Article 24 – Indemnification

Users indemnify Road Trip Car against third-party claims regarding damage suffered due to: (i) using services and/or products of Providers; (ii) using Road Trip Car’s Services; (iii) unlawful content within an Offer; (iv) concluding agreements based on an Offer.

Article 25 – Complaints

If a User is unsatisfied with Road Trip Car’s Services, complaints must be reported as soon as possible, but no later than 7 calendar days after the incident causing the complaint. Complaints should be submitted in writing via Road Trip Car’s customer service.
Complaints regarding car rentals themselves should be filed directly with the Rental Company.
The User must sufficiently substantiate and/or clarify the complaint for Road Trip Car to process it.
Road Trip Car will substantively respond to complaints as soon as possible, but within 30 calendar days of receipt at the latest.
Both parties will aim to reach a mutually agreeable solution.

Article 26 – Intellectual Property Rights and Unauthorized Use

Unless otherwise indicated, software necessary for Platform operation, Service provision, Offer presentation, and intellectual property (including copyright and database rights) of content, information, and materials on the Platform, belong to Road Trip Car.
Non-Road Trip Car products, services, or companies mentioned on the Platform, such as logos or product names, are identified for reference purposes. Intellectual property rights to these belong to their respective owners.
Photos are the intellectual property of Road Trip Car, except for stock photos and third-party photos made available to Road Trip Car with permission.
User reviews and ratings on the Platform must not be copied, scraped, published, promoted, traded, integrated, or otherwise used without Road Trip Car’s explicit consent.
Users receive a non-exclusive, non-transferable, non-sublicensable right to use the Platform and Services. Users never gain ownership of the Platform or any rights associated with it.
Road Trip Car retains exclusive intellectual property rights over all copies of the Platform and its software. These rights are not transferred when using the Platform or purchasing Services or Offers.

Article 27 – Amendments

Road Trip Car reserves the right to modify (parts of) the Platform, its Service content, and these Terms. Updated terms will be published on the Platform, along with the date of the latest update.
These Terms apply to Platform usage from their publication date and are subject to future amendments.

Article 28 – Applicable Law

The legal relationship between Road Trip Car and the User is governed by Dutch law.
Any disputes arising from the use of Road Trip Car’s Services or the Platform between Road Trip Car and the User will be settled by the competent court of Gelderland, Arnhem location, unless mandatory law dictates another competent court.
If any provision of these Terms is deemed illegal, invalid, or unenforceable by a court, this shall not affect the legality, validity, or enforceability of the remaining provisions.
A waiver by Road Trip Car of any breach by a User, Provider, and/or Partner does not imply a waiver of any subsequent breaches by that party or entity.
In case of a dispute, Road Trip Car aims for a resolution in consultation with the User.
If a dispute remains unresolved, the User may seek an independent dispute resolution process, such as an accredited consumer organization.
